Here is the brief Best Practices for Drafting an AI Policy guide I wrote because my LinkedIn followers requested:

Any feedback is appreciated. Let me know if it is helpful that I include part 2, called 10 Questions for In-House Counsel on Corporate AI Policy.

Our approach to AI usage doesn't involve creating a separate AI policy because our current policies already address the risks that are associated with Generative AI use. In addition to those existing policies, our focus is on providing proper training and education to show employees how to use it and further emphasize its risks.

In my opinion, this is a bit analogous to what we went through with COVID policies when by the time you finished creating the policy, it was already out of date. What’s different with AI is that we already have frameworks with appropriate fencing to limit the risks. Now, it’s about getting employees to understand those risks and act accordingly.

We sent our guidance in the early summer, with a series of Do’s & Don'ts, and then will expect to send an update every few months as we learn more about Generative AI. This will be an ongoing process that requires active engagement. Our focus is not on a standalone AI policy but rather on properly educating our employees on the risks and how the current policies apply.

I have been following the development of corporate governance policies around the use of generative AI. This provides a good summary and some recommendations for boards:  https://corpgov.law.harvard.edu/2023/06/21/generative-artificial-intelligence-and-corporate-boards-cautions-and-considerations/
