European Union Regulation 2023/2854 (the EU Data Act) introduces mandatory statutory rights that eliminate cloud switching fees and data egress charges, effective 12 January 2027. While this legislation removes financial penalties for data extraction, it is important to remember that free data egress does not equate to free data migration. If an organization wants to utilize this when it is available, IT procurement leaders must establish rigorous procurement governance, audit contract scope, and mandate technical transition plans before initiating vendor offboarding.
